Employees are under your control. You decide when they work, for how long, and with what tools or supplies.

Contractors are their own boss. They decide the rules, or at least there's a mutual agreement on the terms.

Let's be clear here: you've got to get this right. If you treat an employee as a contractor just to avoid payroll taxes, it's bad news. Back payroll taxes, interest and penalties, workers' compensation complications, and state labor law violations could all come down the pipeline.

In other words, if you rule them, you employ them.
